Summary (not legally binding). This summary helps you find your way around these Terms. It is not part of them, and the numbered sections below are what apply. Jurvo is for adults who live in the United States: you must be 18 or older to use it, including as a Guest. You keep ownership of the Cards you post, and you give us a license to show them in the App, in lists, in the archive, in share images and in results. Cards stay on Jurvo after you delete your Account, without your nickname, unless you ask us to remove them. An anonymous Card hides who you are from other people, not from us. Some Cards are written by the Jurvo team. Votes and Verdicts are strangers' opinions, not professional advice, and Jurvo is not a crisis service: in an emergency call 911, and in a crisis call or text 988. Nothing in Jurvo costs money today. If we have a dispute, we each try to settle it informally first; most disputes then go to individual arbitration, unless you opt out within 30 days (section 24).

ARBITRATION NOTICE. Section 24 contains an agreement to arbitrate. Except for small-claims cases and the other exceptions in section 24.3, you and we agree to resolve disputes between us through final and binding individual arbitration instead of in court, and you and we each give up the right to bring or take part in a class action, a class arbitration or any other representative action (section 24.8). In arbitration there is no judge or jury, and a court's review of the result is limited. You can opt out of the agreement to arbitrate within 30 days after you first accept these Terms, as section 24.9 explains.

1. Who we are and what these Terms cover

#Link to this section

These Terms of Service (the Terms) are a legal agreement between you (you) and PuredLab LLC, a New Mexico limited liability company (registration no. 0008109479) (we, us or our). They govern your use of:

  • Jurvo, our service for posting and judging everyday dilemmas, including the Jurvo app for iOS (the App);
  • our website at jurvo.me (the Site); and
  • the features and services we provide through them (together with the App and the Site, the Service).

These Terms are also the license agreement for the App (sometimes called an end-user license agreement, or EULA), and they include the terms Apple requires, in section 15.

The following documents also form part of these Terms: our Content Policy, our Copyright Policy and our Intimate Image Removal process. If one of them conflicts with these Terms, these Terms control. Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle personal information. They are not part of these Terms, and nothing in these Terms reduces what they say.

In these Terms:

  • a Card is a dilemma posted on Jurvo: a short question with two options, together with the category, mood and intensity chosen for it;
  • a Vote is a choice of one of a Card's two options;
  • a Verdict is the result of the Votes on a Card, which is frozen when the Card locks (section 5);
  • a Guest is a person who uses the App without signing in, by choosing "Explore as a guest";
  • an Account is the account you have once you sign in with Apple, with Google or with an email address and password, and a Member is a person who has an Account;
  • Member Content means anything a Member or a Guest submits to the Service, including Cards, nicknames and Votes; and
  • Jurvo Content means everything in the Service other than Member Content, including the Cards our team writes (section 6), the design, text, graphics and logos of the App and the Site, and the totals, percentages, Verdicts, lists and other results we compute.

"Including" means "including without limitation".

2. Who can use Jurvo

#Link to this section

You may use the Service only if all of the following are true:

  • you are at least 18 years old;
  • you live in the United States;
  • you can form a binding contract with us, and no law that applies to you bars you from using the Service;
  • we have not previously banned you from the Service, unless we have told you in writing that you may come back;
  • you are not located in a country or region that is subject to a comprehensive U.S. government embargo, or that the U.S. government has designated as a "terrorist supporting" country; and
  • you are not on any U.S. government list of prohibited or restricted parties, and you are not owned or controlled by, or acting for, anyone who is.

We offer the Service only in the United States, and only for personal, non-commercial use. If you live in the United States, you may also use the Service while you travel abroad, except from a country or region that the embargo condition above covers.

Guests are not asked their age, but the age requirement applies to them too: by continuing as a Guest, you confirm that you are at least 18. To create an Account, you must also enter your date of birth (section 4.6).

3. How you accept these Terms

#Link to this section

The sign-in screen of the App shows the following sentence below every sign-in option and below the guest option, with links to these Terms and to the Privacy Policy: "By continuing, or by signing in to an existing Jurvo account, you agree to our Terms and acknowledge that you have read our Privacy Policy."

You accept these Terms when you tap "Continue with Apple", "Continue with Google", "Continue with Email" or "Explore as a guest", when you sign in to an existing Account, or when you otherwise use the Service. If you do not agree to these Terms, do not use the Service.

These Terms bind Guests in the same way as Members. If you create an Account after using the App as a Guest, these Terms continue to apply without interruption. If you only visit the Site, these Terms apply to your use of the Site.

4. Accounts, Guests and signing in

#Link to this section

4.1 Using the App as a Guest

#Link to this section

You can use the App without signing in by choosing "Explore as a guest". We then create a Guest profile linked to an anonymous session on your device. As a Guest, you can Vote on a limited number of Cards; posting Cards requires an Account. Votes cast by Guests count in Verdicts in the same way as Members' Votes. The Privacy Policy (section 5) explains what we keep about Guests.

4.2 Creating an Account from a Guest session, or signing in to an existing one

#Link to this section

If you create a new Account from your Guest session, by continuing with Apple, with Google or with a new email address and password, your Guest profile becomes your Account and keeps your Votes and other activity. If you instead sign in to an Account you already have, your Guest activity stays behind: the Votes you cast as a Guest stay counted in Verdicts, but they are not added to your Account, and we do not move them later.

4.3 Sign in with Apple and Sign in with Google

#Link to this section

"Continue with Apple" uses Apple's Sign in with Apple service. The App asks Apple only for your email address, not for your name. Apple lets you share your real email address or a relay address from Apple's Hide My Email service, which forwards our messages to you (Privacy Policy section 20.1). Apple's own terms apply to your use of Sign in with Apple.

"Continue with Google" uses Google's Sign in with Google service. The App asks Google only for its basic sign-in permissions, so Google gives us your Google account's identifier, your email address and, if your Google account has them, your name and a link to your profile picture. We use that information only to create your Account, sign you in, keep your Account secure and recognize you when you contact us, and the App does not show your Google name or picture to anyone (Privacy Policy section 20.2). Google's own terms apply to your use of Sign in with Google.

4.4 Email and password

#Link to this section

"Continue with Email" lets you create an Account with an email address and a password of at least 8 characters. Choose a password that you do not use anywhere else. We do not currently check that you own the email address you enter, so make sure it is correct: it is how we recognize you when you contact us, including when you ask us to delete your Account.

4.5 Your nickname

#Link to this section

To finish creating your Account, you choose a nickname of 2 to 24 characters. Your nickname is public: it appears on every public Card you post, and other Members can see it on your profile. No two Accounts can have the same nickname, whatever the capitalization ("Sam" and "sam" count as the same nickname). Your nickname must follow the Content Policy: it must not impersonate anyone, contain anyone's personal information (including your own full name, email address or phone number) or be offensive. The App does not let you change your nickname after you choose it; if you need to change it, write to us at [email protected]. We may require you to change a nickname that breaks these Terms, or change or remove it ourselves.

4.6 Date of birth and the age block

#Link to this section

To finish creating your Account, you must also enter your full date of birth. Enter it truthfully. If the date shows that you are under 18, the App blocks the Account, we do not store the date, and the App keeps a marker on your device that stops the App from being used on that device, even after you sign out. The marker may remain if you delete and reinstall the App. We do not lift age blocks, so check the date before you confirm it. We delete a blocked Account, including its sign-in record, within 30 days, and the Privacy Policy (section 6) explains the record we keep.

4.7 One Account per person, and keeping it secure

#Link to this section

You may have only one Account, and only for yourself. Do not share, sell or transfer your Account, create an Account for someone else, or use someone else's. Keep your password secret, protect access to your device, and tell us right away at [email protected] if you think someone else has used your Account. You are responsible for what happens on your Account, unless it results from our failure to take reasonable security measures.

4.8 Not available yet: email codes and password reset

#Link to this section

These features are not available yet. When they launch:

  • Confirming your email address. When you create an Account with an email address and a password, including from a Guest session, we will email a 6-digit code to that address, and you will need to enter it in the App to finish creating your Account. A code will also confirm any new email address that replaces the one on your Account.
  • Password reset. You will be able to choose "Forgot password?" in the App, enter the 6-digit code that we email to the address on your Account, and choose a new password. Until then, if you forget your password, write to [email protected] from the email address on your Account.
  • Only messages about your Account. These emails will contain no advertising, tracking pixels or tracked links (Privacy Policy section 9.4).

5. How the Service works

#Link to this section
  • Your daily set. Each day the App offers you a set of Cards. Swipe right or left to Vote for one of a Card's two options, swipe up to skip it, or swipe down to save it. Each of these actions also has a button. A Card you skip may be shown to you again later.
  • The split. After you Vote, the App shows you how the Votes on that Card are split so far.
  • Posting Cards. Members can post Cards; Guests cannot. To post, you choose a category, a mood and an intensity, write a short question and two options, and choose whether the Card shows your nickname (a public Card) or appears as "Anonymous" (an anonymous Card). The App remembers your default, and you choose again for each Card. Before your Card is published, our automated checks review it, and some Cards are held until a person reviews them (section 12). You cannot edit or delete a Card in the App after you post it, so check it first; section 7.5 explains how to ask us to remove one.
  • Locking and Verdicts. A Card stays open for Votes for a limited time. It locks when it reaches the number of Votes we set for it or when its time runs out. If too few people have voted by then, we may extend its time once. When a Card locks, its Verdict is frozen and does not change. If you posted the Card, the App shows you its progress while it is open and its Verdict when it locks.
  • Lists and the archive. Lists show locked Cards that were the most divisive, the most voted or the most decisive, by day, week and month. The archive lets you browse locked Cards. Cards written by our team (section 6) never appear in lists or the archive, and we may leave other Cards out, for example Cards with very few Votes.
  • Sharing. You can share a Verdict or a list as an image through your device's share sheet. A Verdict image shows the Card's category, question, options and results, can show the option you chose if you voted, and includes a link to the Site. It does not show the author's nickname. Once you share an image, it is out of our control and we cannot recall it.
  • Limits. We limit how many Cards you can Vote on and post, and the limits may differ between Guests and Members. We may change these limits at any time.
  • Changes to the Service. We may add, change or remove features at any time, and parts of the Service may sometimes be unavailable.

6. Cards written by Jurvo

#Link to this section

Some Cards are written by our team, sometimes with help from AI tools. A person on our team approves each one before it can appear. We use these Cards only to fill places in your daily set that Members' Cards leave empty, and we mix them in with Members' Cards. They appear either under a nickname that we created or as "Anonymous", in the same way as Members' Cards. Those nicknames do not belong to real Members, and we do not label these Cards one by one. We do not show you the same one twice, and they never appear in lists or the archive.

Every Vote on these Cards, as on every other Card, is cast by a person using the App, and their vote counts, percentages and Verdicts count only those Votes.

Cards written by our team are Jurvo Content.

7. Your content and the license you give us

#Link to this section

7.1 You keep ownership

#Link to this section

You keep whatever rights you have in your Member Content. These Terms do not transfer ownership of it to us.

7.2 The license you give us

#Link to this section

You give PuredLab LLC, our service providers and our successors a non-exclusive, royalty-free, worldwide license to host, store, copy, format, adapt, display, distribute and publicly show your Member Content, and to combine your Votes with other people's into totals, percentages and Verdicts, for these purposes:

  • showing your Cards in the daily set, on the screens of the App, in lists and in the archive;
  • showing your Cards and their results in share images and links that you or other people create and send;
  • showing a Card's Verdict on pages of the Site, if we offer such pages;
  • computing and showing aggregated results, such as vote totals, percentages, Verdicts and statistics about the Service;
  • moderating your Member Content and keeping the Service safe, including with automated tools that our service providers may run for us; and
  • operating, securing and improving the Service.

We may sublicense these rights only to our service providers, and only so that they can help us run the Service. "Adapt" here means the changes needed to present your Member Content in the Service, such as fitting a Card to a screen or an image. We will not change what your Card says.

7.3 How long the license lasts

#Link to this section

For your Cards, your Votes and the aggregated results that include them, the license is perpetual and irrevocable. Cards and results stay on the Service after you delete your Account, without your nickname, because other people have voted on them and Verdicts depend on them. For the rest of your Member Content, such as your nickname, the license ends when your Account is deleted, except for copies we keep as the Privacy Policy describes. We do not have to keep or show any Member Content, and we may remove Cards at your request (section 7.5).

7.4 What we will not do

#Link to this section

We will not use your Member Content in advertising outside the Service, and we will not sell it, without your permission. We do not use your Member Content to train AI models.

7.5 Removing a Card you posted

#Link to this section

The App does not let you delete a Card after you post it. If you want us to remove one, write to [email protected] from the email address on your Account and tell us which Card it is. We will remove it from the Service unless we have to keep it for a legal reason, such as preserving evidence. A removed Card can remain in backups for up to 30 days. Share images that people have already sent outside Jurvo are beyond our control, and totals and statistics that already include the Card's Votes do not change. If you are asking us to delete personal information, the Privacy Policy (section 17) also applies.

7.6 Your promises about your content

#Link to this section

You promise that you have the rights needed to submit your Member Content and to give us the license in section 7.2, and that your Member Content follows these Terms and the Content Policy, including its rules against identifying other people and sharing anyone's personal information. You are responsible for your Member Content. We do not endorse Member Content, and it does not reflect our views.

8. Anonymity and its limits

#Link to this section

An anonymous Card shows "Anonymous" where a public Card shows the author's nickname. Anonymous means anonymous to other people using Jurvo. It does not mean anonymous to us:

  • We know which Account posted every Card, public or anonymous, and we keep that link for as long as your Account exists.
  • We use that link to moderate Cards, enforce these Terms and keep people safe, and we may disclose it when the law requires it, or when we believe in good faith that disclosure is needed to prevent death or serious harm (Privacy Policy section 10).
  • Every Card, anonymous or public, carries a country taken from your device's region setting, and anyone using the App can access it.
  • The details you write, your choice of words and when you post can identify you to people who know you or your situation.

Do not post anything that you would not want linked to you. Posting anonymously does not change what the Content Policy allows.

9. Votes and Verdicts are opinions, not advice

#Link to this section

Votes and Verdicts reflect the opinions of the people who vote. Those people are strangers who know only what the Card says. A Verdict is not professional advice of any kind, including medical, mental health, legal, financial or relationship advice, and it is not our advice or recommendation. Do not rely on a Verdict for decisions about your health, safety, legal rights or money; talk to a qualified professional instead. You are responsible for the decisions you make.

10. Jurvo is not a crisis service

#Link to this section

Jurvo is not an emergency or crisis service, and we do not watch Cards as they are posted. If you or someone else is in immediate danger, call 911. If you are thinking about suicide or self-harm, or are worried about someone who is, call or text 988 to reach the 988 Suicide & Crisis Lifeline, or text HOME to 741741 to reach Crisis Text Line. Both are free, confidential and available at any time in the United States. Outside the United States, contact your local emergency services.

11. Rules of conduct

#Link to this section

You must follow the Content Policy. We have no tolerance for objectionable content, meaning anything the Content Policy prohibits, or for abusive users. In addition, you must not:

  • post anything illegal, or anything the Content Policy prohibits;
  • harass or threaten anyone, make a real, identifiable person the target of a Card, or share anyone's personal information;
  • impersonate any person or organization, or misrepresent your connection with anyone, including through your nickname;
  • create more than one Account, create Accounts by automated means, or use someone else's Account;
  • manipulate Votes or Verdicts, including by coordinating Votes with others, voting from several Accounts or Guest sessions, or recruiting people to vote on your own Card while it is open;
  • use bots, scripts, scrapers or other automated means to access the Service or to collect information from it, unless we agree in writing;
  • copy, modify, reverse engineer, decompile or disassemble the App, or try to work out its source code, except where the law allows this despite this restriction;
  • access our systems other than through the App and the Site, or get around any limit, security measure or access control, including the limits on Votes and Cards;
  • probe, scan or test the security of the Service, except as our responsible disclosure policy allows;
  • interfere with the Service or with other people's use of it, including by sending malicious code or overloading our systems;
  • use the Service to advertise or sell anything, or for any other commercial purpose, without our written permission;
  • use the Service in a way that breaks any law, including export control and sanctions laws; or
  • help or encourage anyone else to do any of these things.

12. Moderation and enforcement

#Link to this section

12.1 How we moderate

#Link to this section

We use automated checks and human review to enforce these Terms and the Content Policy. Before a Member's Card is published, automated checks look for personal information and other content. Depending on the result and on the Account's history, a Card may be refused, held until a person reviews it, or published straight away. Most Members' Cards are published straight after the automated checks. Cards written by our team do not go through these checks; a person on our team approves each one instead (section 6). Our service also accepts reports sent directly from signed-in Members' accounts, and a Card that receives a set number of them is hidden automatically until a person reviews it. We may review any Card at any time, including after it is published. The Content Policy (section 14) describes how this works. We are not required to monitor the Service, and we do not review every Card before it appears.

12.2 What we may do

#Link to this section

If we believe that content or conduct breaks these Terms, the Content Policy or the law, or creates a risk for Jurvo, for the people who use it or for anyone else, we may, with or without notice:

  • refuse, hold, hide or remove a Card or other content;
  • warn you;
  • suspend your Account for 1 day or for 7 days;
  • ban your Account permanently, which we may do straight away for the most severe violations, such as content that sexualizes a minor, threats of violence, or encouraging others to harm themselves; and
  • preserve content and information, and report it to law enforcement or, where the law requires, to the National Center for Missing & Exploited Children (NCMEC).

We may take the same steps for a Guest's access to the Service. While an Account is suspended or banned, it cannot post Cards or Vote. A person on our team decides every warning, suspension and ban. The Content Policy (section 15) describes how we usually respond, but we may depart from it when a situation calls for it.

12.3 Appeals

#Link to this section

If we remove your Card or take action against your Account and you believe we made a mistake, you can appeal by emailing [email protected] within 30 days. Put "Appeal" in the subject line, and tell us which Card or decision you are appealing and why. A person will review your appeal, and we aim to answer within 14 days.

12.4 Reporting

#Link to this section

To report a Card or a person, email [email protected] as the Content Policy (section 17) describes. A person reviews every report sent this way, and we act on reports of content that breaks these Terms or the Content Policy within 24 hours of receiving them, by removing the content and taking action against the account that posted it, up to a permanent ban (section 12.2).

13. Not available yet: paid features

#Link to this section

Jurvo is free, and nothing in the App can be bought today. If we offer paid features, such as subscriptions or one-time purchases, the following will apply, together with the terms shown when you buy:

  • Apple processes payments. Purchases will be made through Apple's In-App Purchase system and charged by Apple to the payment method on your Apple Account. Apple's terms and policies apply to every purchase.
  • What you see before you buy. Before you buy, the App will show the price, what is included and, for a subscription, the length of each period, the fact that it renews automatically, and how to cancel.
  • Automatic renewal. A subscription will renew automatically at the end of each period, at the price then in effect, until you cancel it.
  • Cancelling. You will be able to cancel at any time in the subscription settings of your Apple Account. To avoid being charged for the next period, cancel at least 24 hours before the current period ends. Cancelling stops future renewals, and you keep access until the end of the period you have paid for. Deleting the App or your Account does not cancel a subscription.
  • Refunds. Apple handles all refund requests under its policies, at reportaproblem.apple.com. We cannot issue refunds for purchases made through Apple, except where the law requires otherwise.
  • Price changes. Apple will tell you about a price increase before it applies and, where Apple's process or the law requires, ask for your consent. If you do not agree, you can cancel before the new price applies.
  • State automatic renewal laws. We will comply with the automatic renewal laws of California and other states, including clear disclosure of the renewal terms before you buy, your express consent, an easy way to cancel online, notice of material changes, and any reminders those laws require.
  • Virtual items. Virtual items, such as boosts, will have no cash value, cannot be transferred, sold or exchanged for money, and may expire as described when you get them.
  • Losing access. If your Account is deleted, or banned for breaking these Terms, during a paid period, you will lose access to what you paid for, without a refund from us except where the law requires one.

14. Your license to use the App

#Link to this section

As long as you comply with these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App for your personal, non-commercial use on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (the Usage Rules). Other Apple accounts associated with yours through Family Sharing or volume purchasing may also use the App where the Usage Rules allow, but anyone who uses the App must meet section 2. You may not rent, lease, lend, sell, redistribute or sublicense the App. This license also covers updates to the App, unless an update comes with its own terms. We keep all rights that these Terms do not expressly grant.

15. Terms that apply because you got the App from Apple

#Link to this section

The following terms apply to the App you get from Apple's App Store:

  • (a) Acknowledgement. These Terms are between you and PuredLab LLC only, and not with Apple Inc. (Apple). PuredLab LLC, not Apple, is solely responsible for the App and its content. These Terms do not set usage rules for the App that conflict with the Apple Media Services Terms and Conditions in effect on the date you accept these Terms; if any term would conflict, Apple's terms apply instead, to that extent.
  • (b) Scope of license. Your license to the App is the non-transferable license in section 14, to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules, including use by other accounts associated with you through Family Sharing or volume purchasing.
  • (c) Maintenance and support. PuredLab LLC alone is responsible for providing any maintenance and support for the App, as these Terms describe or as the law requires. Apple has no obligation at all to provide any maintenance or support for the App.
  • (d) Warranty. PuredLab LLC alone is responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to the App. As between PuredLab LLC and Apple, any other claims, losses, liabilities, damages, costs or expenses caused by any failure to conform to a warranty are PuredLab LLC's sole responsibility.
  • (e) Product claims. PuredLab LLC, not Apple, is responsible for addressing any claims by you or by any third party relating to the App or to your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar laws, including in connection with the App's use of the HealthKit and HomeKit frameworks (the App uses neither). These Terms do not limit PuredLab LLC's liability to you beyond what the law permits.
  • (f) Intellectual property claims. If any third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, PuredLab LLC, not Apple, is solely responsible for investigating, defending, settling and discharging the claim.
  • (g) Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
  • (h) Our name, address and contact information. Please direct any questions, complaints or claims about the App to PuredLab LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. Email [email protected] with questions and complaints, and [email protected] with claims and legal notices. Our telephone number is +1 (212) 498-9628; it is our line for legal and copyright matters, and we do not provide support by phone.
  • (i) Third-party terms. When you use the App, you must comply with any third-party terms that apply to you, such as your agreement with your wireless carrier or internet provider.
  • (j) Third-party beneficiary. You and PuredLab LLC agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Feedback

#Link to this section

If you send us ideas, suggestions or other feedback about the Service, we may use them for any purpose without paying you or owing you anything, and without keeping them confidential. Feedback does not include your Member Content, which section 7 covers.

17. Third-party services, links and parental controls

#Link to this section

The Service relies on services provided by other companies, such as Apple's App Store, Sign in with Apple and Sign in with Google. Their own terms and privacy policies apply to your use of them, and we are not responsible for them. The Service may also link to other websites, such as crisis services. We do not control those websites and are not responsible for their content or practices.

As 47 U.S.C. §230(d) requires, we notify you that parental control protections, such as computer hardware, software or filtering services, are commercially available and may help you limit access to material that is harmful to minors. Current providers include Apple, whose Screen Time feature is built into iPhone and iPad and lets a parent restrict apps and content, as well as Google (Family Link) and Microsoft (Family Safety).

18. Our intellectual property

#Link to this section

The Service and the Jurvo Content, including the Jurvo name and logo, belong to PuredLab LLC or its licensors and are protected by intellectual property laws. Apart from the license in section 14, these Terms give you no rights in them. You may not use our name, logo or other trademarks without our written permission, except to refer to Jurvo accurately. Some parts of the App and the Site, such as fonts and open-source software, are provided under their own licenses, which apply to those parts in place of these Terms where the two conflict.

19. Copyright, intimate images and privacy

#Link to this section
  • If you believe that content on Jurvo infringes your copyright, follow our Copyright Policy. In appropriate circumstances, we end the Accounts of people who repeatedly infringe.
  • If an intimate image or video of you, real or AI-generated, has been shared on Jurvo without your consent, or a Card points to one, use our Intimate Image Removal process. We act on valid requests within 48 hours.
  • Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle personal information.

20. Ending your use, suspension and Account deletion

#Link to this section

20.1 You can stop at any time

#Link to this section

You can stop using the Service at any time. To delete your Account, email [email protected] from the email address on your Account, as our Delete your account page explains. We verify your request and delete your Account 30 days after we receive it, or as soon as we have verified it if that takes longer; that page gives the details. Until then it keeps working, and you can cancel the deletion by email.

20.2 What stays after your Account is deleted

#Link to this section

When your Account is deleted, your Cards stay on the Service without your nickname or any link to your Account, unless you ask us to remove them (section 7.5). Your Votes stay in totals and Verdicts without any link to you, and locked Verdicts do not change. The Delete your account page lists what we delete and what we keep.

20.3 Suspension and termination by us

#Link to this section

We may suspend or end your access to all or part of the Service, or delete your Account, if you break these Terms or the Content Policy, if the law requires it, if your use creates a risk or possible legal exposure for us, for the people who use Jurvo or for anyone else, or if we stop offering the Service. Where it is reasonable and lawful, we will tell you in advance and explain why.

20.4 Not available yet: deleting your Account in the App

#Link to this section

You cannot delete your Account in the App yet. When this feature launches, you will be able to start the deletion from the App, and the same 30-day window and rules will apply.

20.5 What survives

#Link to this section

Sections 7.2 and 7.3 (as they apply to Cards, Votes and aggregated results), 7.6, 9, 10, 16, 18, 20.2, 20.5 and 21 to 29 continue to apply after these Terms end, and so does any other term that by its nature should survive.

21. Disclaimer of warranties

#Link to this section

DISCLAIMER OF WARRANTIES. To the fullest extent permitted by law, the Service, including the App, the Site, Member Content and Jurvo Content, is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. PuredLab LLC disclaims all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranties arising from a course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure or free of errors, viruses or other harmful components; that any defect will be corrected; that any Card, Vote, Verdict or other content is accurate, complete or reliable; or that the Service will meet your needs. We are not responsible for Member Content or for the conduct of anyone who uses the Service. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you (section 28).

22. Limitation of liability

#Link to this section

LIMITATION OF LIABILITY. To the fullest extent permitted by law: (a) neither PuredLab LLC nor its owners (the members of the limited liability company), managers, employees, agents, service providers or licensors (together, the Jurvo Parties) will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to these Terms or the Service, even if we have been told that they are possible; and (b) the total liability of the Jurvo Parties for all claims arising out of or relating to these Terms or the Service will not exceed the greater of US$100 or the total amount you paid PuredLab LLC, directly or through Apple, for Jurvo in the 12 months before the claim arose. These limits apply to every legal theory, including contract, tort (including negligence), strict liability and statute, and even if a limited remedy fails of its essential purpose. They do not apply to the extent the law does not allow them, for example where a state does not allow a limit on liability for fraud, gross negligence, willful misconduct, or death or personal injury, or does not allow consumer protection rights to be waived. Some states do not allow these limits, so some of them may not apply to you (section 28).

23. Indemnity

#Link to this section

To the extent the law allows, you will indemnify and hold harmless the Jurvo Parties from and against claims brought by third parties, and the resulting losses, damages, liabilities, costs and reasonable attorneys' fees, to the extent they are caused by (a) Member Content you submit, or (b) your violation of these Terms or of the law. You do not have to indemnify the Jurvo Parties for any claim to the extent it is caused by their own acts or omissions. We will tell you promptly about any claim covered by this section. You may defend the claim with counsel reasonably acceptable to us, and we will cooperate at your expense; we may take part in the defense with our own counsel at our own cost. You may not settle a claim in a way that admits fault on our behalf or imposes an obligation on us without our written consent, and we will not settle a claim in a way that imposes an obligation on you without your written consent.

24. Dispute resolution and arbitration

#Link to this section

This section affects your legal rights, so please read it carefully. It applies equally to you and to us.

24.1 Informal resolution first

#Link to this section

Before either of us starts an arbitration or a small-claims case against the other, the party with the dispute must send the other a written notice of dispute (a Notice of Dispute) and give the other 60 days to try to resolve it informally. Send your Notice of Dispute by email to [email protected] with the subject line "Notice of Dispute", or by mail to PuredLab LLC, Attn: Legal, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. We will send ours to the email address on your Account, if there is one, or by other reasonable means. A Notice of Dispute must include the sender's name and contact information, the email address on the Account (if any), a description of the dispute and the relief requested. During the 60 days, either of us may ask for a telephone or video call to discuss the dispute, and the other will take part in good faith; you may bring a lawyer. All statutes of limitations, and all deadlines for paying filing fees, are suspended from the date the Notice of Dispute is received until the 60 days end. If the dispute is not resolved within the 60 days, either of us may start an arbitration or, where section 24.3 allows, a court case.

24.2 Agreement to arbitrate

#Link to this section

Except as section 24.3 provides, you and PuredLab LLC agree to resolve every dispute, claim or controversy between us that arises out of or relates to these Terms, the Service or your relationship with us, whether based on contract, statute, tort or any other legal theory, and whether it arose before or after you accepted these Terms (each, a Claim), only through final and binding individual arbitration. This applies equally to Claims you bring against us and to Claims we bring against you. It also applies to disputes between you and our owners, managers, employees or agents that relate to their work for us, which are Claims too. Each of them may rely on this section, and any of them who relies on it is bound by it for Claims they bring against you. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. §1 and following).

24.3 Exceptions

#Link to this section

The following Claims do not have to be arbitrated:

  • (a) Small claims. Either you or we may bring an individual Claim in a small claims court that has jurisdiction over it, instead of in arbitration, for as long as the Claim stays in that court and is pursued only on an individual basis.
  • (b) Claims that federal law keeps out of arbitration. If federal law, including the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, gives the person bringing a Claim the right to take it to court despite an agreement to arbitrate, that person may choose to bring that Claim in court.
  • (c) Public injunctive relief. Where the law does not allow a request for public injunctive relief (relief whose main purpose is to stop unlawful acts that threaten the general public) to be waived or decided in arbitration, a court will decide that request, but only after the arbitrator has decided all individual Claims and remedies. The court case on that request will be paused until then.

24.4 Arbitration rules and provider

#Link to this section

The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules in effect when the arbitration starts (the Consumer Rules), as modified by these Terms, and, when section 24.7 applies, under its Mass Arbitration Supplementary Rules. A single neutral arbitrator will decide each case. The arbitrator may award any individual relief that a court could award on an individual basis, including damages, declaratory relief and injunctive relief, but only in favor of the individual party seeking it and only to the extent needed to provide relief on that party's individual Claim. The arbitrator must follow these Terms and the law and, at either party's request, will issue a written decision explaining the reasons for the award. A court with jurisdiction may enter judgment on the award. If the AAA is unable or unwilling to administer the arbitration, you and we will agree on another arbitration provider, and if we cannot agree, a court will appoint an arbitrator under 9 U.S.C. §5.

24.5 Fees and costs

#Link to this section

Filing, administration and arbitrator fees will be paid as the Consumer Rules provide or, when section 24.7 applies, as the Mass Arbitration Supplementary Rules provide. Under those rules, the business pays most of these fees. Each party pays its own attorneys' fees and costs, unless the arbitrator awards them under applicable law or the AAA's rules. The arbitrator may also award fees and costs against a party whose Claim or defense is frivolous or brought for an improper purpose, applying the standard in Rule 11 of the Federal Rules of Civil Procedure. This applies equally to both of us.

24.6 Where and how the arbitration takes place

#Link to this section

The arbitration will be decided on written submissions or at a hearing by video conference, as the Consumer Rules provide, unless the arbitrator decides that an in-person hearing is needed. Any in-person hearing will take place in the county in the United States where you live, unless you and we agree on another place. The arbitration will be conducted in English.

24.7 Mass arbitration

#Link to this section

If the AAA's Mass Arbitration Supplementary Rules apply to a group of demands for arbitration under their own terms (today, 25 or more similar demands filed against us or by us with the same or coordinated counsel), those rules and their fee schedule will apply to those demands, together with the Consumer Rules, and the AAA will administer them under those rules. Each demand remains an individual case, and section 24.1 applies to each claimant.

24.8 Class action and representative action waiver

#Link to this section

CLASS ACTION AND REPRESENTATIVE ACTION WAIVER. You and PuredLab LLC each agree that each of us may bring Claims against the other only in an individual capacity, and not as a plaintiff, class member or representative in any purported class, collective, consolidated or representative proceeding, including a private attorney general action. The arbitrator may decide only one person's individual Claims and may not preside over any form of class, collective or representative proceeding, or award relief to anyone other than the individual party seeking it. The AAA may assign similar cases to the same arbitrator under its rules, but each case is decided separately. Class arbitration is never permitted under these Terms. If a court decides, after any appeals, that this waiver cannot be enforced for a particular Claim or request for relief, then that Claim or request, and only that one, will be removed from the arbitration and decided in court, not in arbitration, after the individual Claims in arbitration have been decided.

24.9 Opting out of arbitration

#Link to this section

You can opt out of this agreement to arbitrate (sections 24.2 to 24.8 and 24.10) within 30 days after you first accept these Terms. To opt out, email [email protected] with the subject line "Arbitration opt-out", or write to PuredLab LLC, Attn: Legal, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. Include your name, the email address on your Account (or, if you use Jurvo only as a Guest, a statement that you are a Guest and the date you started using the App), and a clear statement that you opt out of arbitration. An opt-out you sent for an earlier version of these Terms stays in effect. Opting out does not affect the rest of these Terms. If you opt out, Claims between us are heard in court as section 25 describes.

24.10 Changes to this section

#Link to this section

If we change this section 24 after you have accepted it, other than to update our contact details, we will give you at least 30 days' notice before the change takes effect. You may reject the change by emailing [email protected] before it takes effect, and the version of this section that you last accepted will then continue to apply to Claims between us. A change never applies to a Claim that either of us has already sent a Notice of Dispute about.

24.11 Who decides, and severability

#Link to this section

The arbitrator decides all questions about the interpretation, scope, applicability and enforceability of this agreement to arbitrate, except that a court decides: (a) whether a Claim falls within an exception in section 24.3; (b) whether section 24.8 can be enforced; and (c) whether you opted out under section 24.9 or rejected a change under section 24.10. If any other part of this section 24 is found to be unenforceable, the rest of it stays in effect, subject to section 24.8.

25. Governing law and where disputes are heard

#Link to this section

The Federal Arbitration Act governs section 24. Otherwise, these Terms and every Claim are governed by the laws of the State of New Mexico and by applicable federal law, without regard to conflict-of-law rules. This choice of law does not take away any protection of the law of the state where you live that cannot be waived by agreement.

A Claim that is not arbitrated, whether because of an exception in section 24.3, because you opted out, or because a court decides that it must be heard in court, may be brought only in the state courts located in Bernalillo County, New Mexico, or in the United States District Court for the District of New Mexico, and you and we consent to the personal jurisdiction of those courts. This does not apply to small-claims cases, which may be brought in any small claims court with jurisdiction, or where the law of the state where you live gives you the right to bring a Claim in a court there.

26. Changes to these Terms

#Link to this section

We may change these Terms from time to time, for example to reflect changes to the Service, to the law or to our practices. When we do, we will post the new version on the Site and update the date shown at the top of these Terms. If a change is material, we will also tell you at least 30 days before it takes effect, by email to the address on your Account or by a notice in the App. Changes that are not material take effect when we post them. Changes to section 24 follow section 24.10. If you keep using the Service after a change takes effect, you accept the changed Terms; if you do not agree, stop using the Service and delete your Account before then. A change does not apply to a dispute that arose before the change was posted.

27. Electronic communications and notices

#Link to this section

27.1 Your consent to electronic communications

#Link to this section

By accepting these Terms, you consent to receive electronically all agreements, notices, disclosures and other communications that we provide in connection with the Service (Communications), including these Terms and any changes to them. You agree that Communications we provide electronically satisfy any legal requirement that they be in writing. You give this consent under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN). We provide Communications by posting them on the Site, by showing them in the App or by email to the address on your Account.

27.2 What you need

#Link to this section

To receive and keep Communications, you need a device with internet access, a current web browser that can open the Site, access to the email account on your Account (if you have an Account), and a way to save or print Communications. If these requirements change in a way that creates a material risk that you cannot access or keep Communications, we will tell you before the change, and you may withdraw your consent without charge.

27.3 Paper copies and withdrawing consent

#Link to this section

You can ask for a free paper copy of any Communication by writing to [email protected] or to our address in section 30. You can withdraw your consent to electronic Communications in the same way, free of charge. Because we provide the Service only electronically, you will then need to stop using the Service, and we may close your Account. Withdrawing consent does not affect Communications we provided before.

27.4 Notices to you

#Link to this section

We may send notices to the email address on your Account, show them in the App or post them on the Site. Guests receive notices in the App or on the Site. The App does not let you change your email address; if it changes, tell us at [email protected].

27.5 Notices to us

#Link to this section

Legal notices to us, including Notices of Dispute, arbitration opt-outs and rejections of changes, must be sent by email to [email protected] or by mail to PuredLab LLC, Attn: Legal, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. A notice to us takes effect when we receive it.

28. State-specific notices

#Link to this section
  • Rights under the law of your state. Some states do not allow certain warranties to be excluded, certain damages or liabilities to be limited, or certain other terms, so some of sections 21, 22 and 23 may not apply to you. Nothing in these Terms limits a right you have under the law of your state that cannot be waived by contract.
  • California. Under California Civil Code §1789.3, California users are entitled to this notice: the Service is provided by PuredLab LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States; using the Service is free of charge today; and you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
  • New Jersey. If you live in New Jersey, sections 21, 22 and 23 apply to you only to the extent New Jersey law allows, and nothing in these Terms limits any right you have under New Jersey law.

29. General terms

#Link to this section
  • Entire agreement. These Terms, including the documents that section 1 makes part of them, are the entire agreement between you and us about the Service, and they replace any earlier agreement about it.
  • Severability. If any part of these Terms is found to be unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms stays in effect, subject to section 24.8.
  • No waiver. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization or sale of all or part of our business or assets, or by operation of law, and we will tell you if we do.
  • Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control, such as natural disasters, outages of third-party services, or acts of government.
  • Relationship. These Terms do not create a partnership, joint venture, employment or agency relationship between you and us.
  • Third-party beneficiaries. Apple (section 15(j)) may rely on these Terms, the Jurvo Parties on sections 22 and 23, and our owners, managers, employees and agents on section 24 as section 24.2 describes. No one else has rights under them.
  • Headings and language. Headings are for convenience only. These Terms are written in English; if we provide a translation, the English version controls.
  • Export. You must comply with U.S. export control and sanctions laws when you download or use the App.
